## Article 4 for house shares

Broxtowe has an Article 4 direction on HMOs (shared houses). Turning a family home into a shared house may need planning permission.

- Area: Parts of Beeston and Beeston Rylands only, as shown on the council's map (https://www.broxtowe.gov.uk/media/8306/site-notice-map.pdf). Within that area planning permission is needed to change a dwellinghouse to an HMO with 3-6 residents. Consulted 15 January to 26 February 2021; confirmed by the Jobs & Economy Committee on 25 March 2021; in force 26 March 2022.
- Takes effect: 26 March 2022

## Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

Broxtowe Borough Council Private Sector Housing Civil Penalties Policy (March 2026), Appendix 2 to the Cabinet report of 2 June 2026, which resolved that 'The updated Housing Civil Penalties Policy be approved' alongside a Private Sector Housing Enforcement Policy incorporating the Renters' Rights Act 2025 (https://democracy.broxtowe.gov.uk/mgAi.aspx?ID=19586). Offences such as failure to obtain a selective licence (s.95) carry a statutory maximum of £40,000, with a civil penalties matrix. An earlier civil penalties policy went to the Housing Committee on 2 February 2021. The HMO licence page still cites £30,000.

## Consultations

We found no consultations when we researched Broxtowe.

## Not yet confirmed

We could not settle these points when we researched Broxtowe on 26 October 2026. Check them with the council before you rely on them.

- No selective or additional licensing scheme in force or proposed. The Cabinet business plan progress report (8 September 2026), action COMS2427_02 'To consider whether an additional licensing scheme for private rented dwellings would be appropriate', says 'It is unlikely that an additional licensing scheme will be pursued within the next 2 years' and that options including 'a Planning Article 4 for HIMOs' are being considered. Re-check for any later decision.

## Landlord register

The national landlord register is separate from licensing. Broxtowe is in East Midlands, where registration is planned from 15 February 2027 to 14 May 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
