## Licensing schemes

### Mandatory HMO licence: Mandatory HMO licensing

- Status: In force (`in_force`)
- Area: The Cheshire West and Chester Council area. Cheshire East is a separate authority. Chester's three mapped HMO Article 4 planning areas do not restrict mandatory housing licensing to those areas.
- Fee: Published standard fee: £786. Current live fees and the council's 2026/27 fees schedule (as at 1 April 2026) publish £786 up to six habitable rooms, £832 seven, £879 eight, £925 nine and £968 ten or more on the live page. Habitable rooms include bedrooms AND living rooms; kitchens, combined kitchen/dining rooms, bathrooms and outhouses are excluded. These are not occupant/bedroom bands. CLAS-accredited landlords are offered a 10% reduction; the schedule separately prints discounted amounts £708/£749/£790/£832/£871, which are retained as published rather than recalculated. The schedule labels the top band 'up to 10' whereas the live page says '10 or more'; confirm charges for larger properties. Schedule includes new licences and renewals, per five-year licence; variation £91. No two-stage split established.
- Licence length: 5 years
- Who needs one: HMOs occupied by five or more people forming two or more households and sharing basic facilities, subject to the statutory exclusions. The council describes five or more unrelated people sharing.
- Apply: https://www.cheshirewestandchester.gov.uk/residents/housing/private-rented-sector/landlord-and-tenant-information/house-in-multiple-occupation/hmo-licencing
- Confidence: High
- How we checked this: Applications, renewals and amendments are linked through GOV.UK by the council. The licensing page requires suitable accommodation, a fit and proper licence holder/manager and satisfactory management arrangements. The amenities guide is not treated as a complete issued licence-conditions document. Fresh targeted official housing, designation, consultation and committee searches found no additional/selective designation currently operative, approved future scheme, live licensing consultation or optional scheme ended within the preceding twelve months. This is bounded research, not express council confirmation of absence. Generic powers in a national 2019 rights booklet hosted by the council are not a local designation; Local Plan consultation respondents' suggestions are not council approval.

## Article 4 for house shares

Cheshire West and Chester has an Article 4 direction on HMOs (shared houses). Turning a family home into a shared house may need planning permission.

- Area: Three separate red-edged areas in Chester: Garden Quarter (operative 8 July 2013), Newry Park and King Street (both operative 2 May 2016). Each removes C3-to-C4 permitted development rights for small HMOs; existing lawful uses are not made retrospective. All three signed directions and all three separate boundary plans were fetched and visually inspected. The controls apply to the actual red-edged land, not entire named roads, all Chester or whole current wards. Garden Quarter was made 3 July 2012 and confirmed 12 February 2013; Newry Park and King Street were made 8 April 2015 and confirmed 12 November 2015. Current index links signed orders and boundary plans under https://planningpolicy.cheshirewestandchester.gov.uk/sites/planningpolicy-cheshirewestandchester/files/2025-11/ . The separately published 2026 Class E-to-residential commercial Article 4 proposals are not HMO directions.
- Takes effect: 8 July 2013

## Civil penalty policy

The council's policy sets how it decides the size of a fine.

The current corporate policies index links this general enforcement policy, approved by Cabinet on 18 March 2020 (minute 100). It covers services including private sector housing but is not evidence of a current housing-specific civil penalty matrix or adoption of the Renters' Rights Act 2025 framework. No current adopted housing CPP/RRA replacement or its matrix was established in fresh official searches; no penalty maximum or starting amount is inferred from the corporate policy.

## Consultations

We found no consultations when we researched Cheshire West and Chester.

## Not yet confirmed

We could not settle these points when we researched Cheshire West and Chester on 15 October 2026. Check them with the council before you rely on them.

- Obtain express current council confirmation of additional/selective licensing absence and any new designation, consultation or scheme expired since 15 October 2025; absence of a recovered designation is not definitive proof.
- Recover the current housing-specific civil penalty policy, adoption decision and RRA2025 transition/effective dates. The retrieved 2020 corporate enforcement policy does not resolve them.
- Confirm current complete licence conditions, statutory exclusions and any payment split not stated in the retrieved guidance.
- Confirm the fee for more than ten habitable rooms: current live guidance says £968 for ten or more, while the 2026/27 schedule labels that band 'up to 10'. Discounted schedule amounts do not all equal simple 10% arithmetic; use the council's quoted figures.
- Exact Article 4 applicability requires the separate legal red-edged plans/address confirmation; no whole-road or current-ward equivalence is claimed.

## Landlord register

The national landlord register is separate from licensing. Cheshire West and Chester is in North West, where registration is planned from 15 May 2027 to 14 August 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
