## Licensing schemes

### Mandatory HMO licence: Mandatory HMO licensing

- Status: In force (`in_force`)
- Area: Whole Cumberland Council administrative area, comprising the former Allerdale, Carlisle and Copeland districts. Housing licensing applies across the council area, including places where the Lake District National Park Authority handles planning.
- Fee: Published standard fee: £750. The published 2026/27 schedule, effective 1 April 2026, lists £750 for a new HMO licence and £450 for renewal, described as per eight lettings, plus £21 for each additional letting room. Confirm the exact letting-room count and interpretation for a larger property. A 5% HMO fee discount is available for landlords with professional membership of the NRLA. A licence-holder-requested variation costs £165; an external fit and proper person validation costs £150 if required. Additional correspondence is £42. Optional HMO advice is separately priced at £80 for a council-building meeting or £250 for an advisory visit to a proposed new HMO; these are not licence fees. The council states the current charges replace former sovereign council fee policies, so old district prices are not applied. No separate early application discount or payment-stage split is stated in the current table.
- Licence length: 5 years
- Who needs one: HMOs occupied by five or more people forming more than one household and sharing kitchen or bathroom facilities, subject to the statutory prescribed description. Each licensable property requires its own licence.
- Exemptions: Statutory HMO licensing exclusions apply. The council can consider a temporary exemption when a property will cease to be licensable; this must be granted and is time limited.
- Apply: https://www.cumberland.gov.uk/housing/housing-advice/houses-multiple-occupation-hmos
- Confidence: High
- How we checked this: The council expressly states it does not currently operate additional HMO licensing or selective licensing. The current enforcement policy repeats that position and says schemes are reviewed for consideration. Licences are usually granted for up to five years, with shorter terms possible. Applications and advice are routed through the former Allerdale, Carlisle and Copeland housing teams, but that does not create three separate licensing designations or fee schedules. The new unitary council took over on 1 April 2023. Property-specific licence conditions govern permitted occupancy, fire safety and management; a housing licence does not grant planning permission. Old Allerdale and Copeland policy documents must not be substituted for the current unified Cumberland policy.

## Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

A delegated decision by the Director of Public Health, Customer and Community Wellbeing on 18 June 2026 approved the RRA-aligned policy and associated statement and civil penalty framework; it was published on 19 June. A further HHSRS policy update was approved on 17 July and is recorded as implemented. The current linked enforcement policy is version 3, uploaded August 2026, with RRA provisions despite retaining a draft label in document control. The accompanying principles cover £7,000 and £40,000 statutory maxima and refer to the ACEHO matrix for RRA matters. A 15% prompt payment discount normally requires full payment within 28 days beginning the day after the final notice; appeals do not extend it. A separate 20% early payment reduction in the smoke-alarm section must not be applied to every housing penalty. Formal June approval: https://cumberland.moderngov.co.uk/documents/s56600/06.18.26%20-%20Cumberland%20Private%20Sector%20Housing%20Enforcement%20Policy%20-%20redacted.pdf. Later July approval: https://cumberland.moderngov.co.uk/documents/s57137/2026.07.17%20-%20Private%20Sector%20Housing%20Enforcement%20Policy%20HHSRS%20Update.pdf. The June decision-summary page still displays For Determination, although its accompanying dated decision PDF expressly records approval; the later July HHSRS update is recorded as implemented. These metadata inconsistencies do not replace the actual decision text. June summary: https://cumberland.moderngov.co.uk/ieDecisionDetails.aspx?Id=857 .

## Consultations

We found no consultations when we researched Cumberland.

## Not yet confirmed

We could not settle these points when we researched Cumberland on 15 October 2026. Check them with the council before you rely on them.

- Confirm the exact room-count interpretation of the published per eight lettings base fee and additional letting-room charge, any instalment arrangements and evidence required for the NRLA discount.
- Recover any confirmed HMO Article 4 instrument or a definitive current council statement of absence. The fetched conservation guidance does not establish C3-to-C4 control; property-specific and National Park restrictions still require checks.
- Reconcile the draft label retained in the current version 3 enforcement policy with the June and July 2026 formal approvals, and confirm any exact transitional commencement rules for historical offences. The formal decisions establish approval; an upload date alone does not. The June summary also retains a For Determination status despite the decision PDF recording approval; confirm corrected document-control metadata with the council.
- Obtain the complete current ACEHO calculation matrix referenced by the principles for property-specific penalty advice. The separate smoke-alarm early-payment rules are not interchangeable with the RRA discount.
- Current HMO guidance and the unified enforcement policy expressly say no additional or selective licensing schemes operate. Targeted current council and committee searches did not establish a recent expiry, future designation or live formal consultation; continue monitoring reviews and later decisions.
- Obtain the actual issued licence conditions and any shorter term for the property; the public HMO page gives only a summary.

## Landlord register

The national landlord register is separate from licensing. Cumberland is in North West, where registration is planned from 15 May 2027 to 14 August 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
