## Article 4 for house shares

Erewash has an Article 4 direction on HMOs (shared houses). Turning a family home into a shared house may need planning permission.

- Area: Confirmed but not yet in force: comes into effect 6 March 2027. Covers large parts of Ilkeston and Long Eaton and parts of Sawley and Sandiacre (see the council's Appendix 2 boundary maps). Removes the C3 to C4 (small HMO) permitted development right. Consultation ran 19 December 2025 to 11 January 2026; confirmed at Full Council on 5 March 2026.
- Takes effect: 6 March 2027

## Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

Civil Penalty Policy 'Final 2.0 July 2026', published on the council's Policies page with a Private Rented Sector Enforcement Policy. It includes a section on Renters' Rights Act 2025 breaches (for example tenancy information, discrimination and rental bidding offences). Penalty bands not extracted.

## Consultations

We found no consultations when we researched Erewash.

## Not yet confirmed

We could not settle these points when we researched Erewash on 26 October 2026. Check them with the council before you rely on them.

- No selective or additional licensing scheme. The council's HMO licence page says: 'The Council do not currently operate any Additional License or Selective Licencing schemes.' A moderngov.erewash.gov.uk search for 'selective licensing' returns only 2019 scrutiny items (a suggestion that was not taken forward).
- The Article 4 direction takes effect on 6 March 2027; check exact address coverage on the Appendix 2 maps (https://www.erewash.gov.uk/sites/default/files/2025-11/Appendix%202%20-%20Area%20Boundaries_1.pdf).

## Landlord register

The national landlord register is separate from licensing. Erewash is in East Midlands, where registration is planned from 15 February 2027 to 14 May 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
