## Licensing schemes

We found no licensing scheme for Hyndburn.

## Article 4 for house shares

Hyndburn has an Article 4 direction on HMOs (shared houses). Turning a family home into a shared house may need planning permission.

- Area: Whole borough, through two C3 to C4 directions: (1) a non-immediate direction in Barnfield, Central, Church, Clayton-le-Moors, Peel, Netherton, Rishton, Spring Hill and St Andrew's wards, in force 15 March 2026; (2) an immediate direction made 15 May 2026 covering Altham, Baxenden, Huncoat, Immanuel, Milnshaw, Overton and St Oswald's wards, in force 22 May 2026, consultation 22 May to 3 July 2026, confirmation not yet found (an immediate direction lapses unless confirmed within six months). The council says that together 'these permitted development rights have now been removed across the whole borough'.
- Takes effect: 15 March 2026

## Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has not been updated for the Renters' Rights Act.

The Hyndburn Private Sector Enforcement Policy 2022 (linked from the council's Housing Enforcement page) includes a civil penalty section and a scoring matrix within the '£30,000 limit', with factors scored across four levels (e.g. harm from Level 1 'Minor / moderate impact' to Level 4 'Extreme impact'). The Housing Enforcement page still cites the £30,000 maximum under section 126 of the Housing and Planning Act 2016.

## Consultations

- [Consultation on the immediate Article 4 Direction for HMOs (Altham, Baxenden, Huncoat, Immanuel, Milnshaw, Overton and St Oswald's wards)](https://www.hyndburnbc.gov.uk/news/article-4-direction-consultation/): Closed, awaiting decision. Closed 3 July 2026.

## Not yet confirmed

We could not settle these points when we researched Hyndburn on 26 October 2026. Check them with the council before you rely on them.

- No selective or additional licensing scheme is in force. The council's selective licensing page states: 'The Selective Licensing Designation in Hyndburn ended on 4 March 2023' (more than 12 months ago, so it is not listed as a scheme). No new proposal or consultation was found on the council site (searches for 'licensing' and 'HMO') or in a web search.
- No council page or fee for mandatory HMO licensing was found on hyndburnbc.gov.uk (the site's 'HMO' search returns a supported accommodation page only), so mandatory HMO licensing is not listed; the national scheme still applies.
- The immediate Article 4 direction made on 15 May 2026 must be confirmed within six months to remain in force; its confirmation status was not found (the consultation ran from 22 May to 3 July 2026).
- No civil penalty policy updated for the Renters' Rights Act 2025 was found; the 2022 policy and the Housing Enforcement page use the £30,000 maximum.

## Landlord register

The national landlord register is separate from licensing. Hyndburn is in North West, where registration is planned from 15 May 2027 to 14 August 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
