## Licensing schemes

### Mandatory HMO licence: Mandatory HMO licensing (national scheme, Tandridge fee)

- Status: In force (`in_force`)
- Area: The whole of Tandridge District (national scheme).
- Fee: Published standard fee: £868.50. Council HMO page: fee £868.50 for a licence lasting five years. No per-room charge, renewal rate or discount is published there and the page shows no update date.
- Licence length: 5 years
- Who needs one: HMOs occupied by five or more persons forming two or more households, including HMOs occupied by a live-in landlord and four or more tenants (council HMO page).
- Exemptions: The council page lists HMOs run by public sector bodies (housing associations, government departments, police, fire authority, NHS), certain educational establishments and certain religious organisations.
- Apply: https://www.gov.uk/apply-for-a-licence/house-in-multiple-occupation-licence/tandridge/apply-1
- Confidence: High
- How we checked this: The council's HMO page states: 'Tandridge District Council does not operate an Additional or Selective Licensing Scheme.' The council may issue a 12-month licence instead of five years where management arrangements are unsatisfactory (the enforcement policy calls this a one-year trial period). The public HMO register is available by email to eh@tandridge.gov.uk. The HMO page links an HMO standards PDF.

## Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has not been updated for the Renters' Rights Act.

Private Sector Housing Enforcement Policy, January 2022, revised June 2024, linked from the council's enforcement policy page. Its Appendix 3, 'Policy on determining the level of Civil Penalty as an alternative to prosecution under the Housing Act 2004', uses the £30,000 maximum and a culpability and harm matrix based on Sentencing Council principles: starting points from £50 (low culpability, harm category 3) to £15,000 (very high culpability, harm category 1, range £6,250 to £30,000). It covers s.72 HMO licensing offences and s.95 selective licensing offences. It predates the Renters' Rights Act 2025 £40,000 maximum; no revised policy was found on the council site. The Housing Committee on 30 June 2026 (minute 68, https://tandridge.moderngov.co.uk/documents/s19890/x.pdf) considered a revised Private Sector Housing Enforcement Policy 'based on nationally adopted model policies' and resolved 'That the Council be recommended to adopt the revised Private Sector Housing Enforcement Policy to enable the Council to enforce the requirements of the Renters' Rights Act 2025'. Full Council adoption and the revised text were not found; the council website still links the June 2024 revision.

## Consultations

We found no consultations when we researched Tandridge.

## Not yet confirmed

We could not settle these points when we researched Tandridge on 26 October 2026. Check them with the council before you rely on them.

- Confirm whether Full Council adopted the revised Private Sector Housing Enforcement Policy recommended by the Housing Committee on 30 June 2026 for the Renters' Rights Act 2025, and obtain its civil penalty levels; the council website still links the June 2024 revision with a £30,000 maximum.
- Several recent Article 4 records (ENF/2015/266, ENF/2015/267, ENF/2020/372, ENF/2021/365, ENF/2022/82, ENF/2023/322, ENF/2025/128, ENF/2025/224, ENF/2025/231, ENF/2025/245) have no description in the council's open data; they are enforcement-referenced site directions, but their documents were not opened to rule out an HMO control.
- The £868.50 fee page shows no date; confirm it is the current 2026/27 fee.
- No selective or additional licensing proposal was found: besides the council's explicit statement, committee-document searches (tandridge.moderngov.co.uk) for "selective licensing" return no results, and "multiple occupation" returns only the October 2026 Local Plan housing-policy minutes (no Article 4 or licensing item).
- Surrey local government reorganisation: the council's notice says 'from April 2027 East Surrey Council will replace the current areas covered by Elmbridge, Epsom and Ewell, Mole Valley, Reigate and Banstead, and Tandridge councils' (data processed from 1 April 2027 by East Surrey Council; https://www.molevalley.gov.uk/privacy-notice-local-government-reorganisation/). HMO licensing will then be run by the new council; check its fees and any new schemes after that date.

## Landlord register

The national landlord register is separate from licensing. Tandridge is in South East, where registration is planned from 15 March 2027 to 14 June 2027. The regulations are still in draft. Read about the register: https://lettance.com/register
