Mandatory HMO licence
In forceMandatory HMO licensing
- Area
Whole Barnsley Metropolitan Borough Council administrative area, including its towns and rural settlements. A Barnsley postal address outside that council boundary does not establish applicability.
- Fee
Published standard fee: £800
The current council HMO application page quotes £800 for up to five bedrooms, plus £50 for each bedroom above five. The first payment is £368 on application; the second is the remaining balance after approval, £432 for the base five-bedroom fee. A council-arranged DBS check costs extra, but the amount is not stated. No separate renewal discount or early application rate is published. The page does not label a financial year.
- Who needs one
- HMOs occupied by five or more people in two or more households sharing kitchen, bathroom or toilet facilities, subject to the statutory prescribed description.
- Exemptions
- Statutory HMO licensing exclusions and temporary exemptions apply. A purpose-built flat in a block of three or more self-contained flats is excluded from the mandatory prescribed description; unusual converted buildings need individual assessment.
How we checked this
The council says a licence usually lasts five years, is not transferable, and a buyer of an already licensed HMO must apply for their own licence. Supporting mandatory documents must be uploaded within 14 days or the application is refused without refund under the published application instructions. The council requires the proposed holder to have full financial control of the property and says an agent cannot apply on the holder's behalf. The published amenity standards are guidance, not a substitute for the actual licence conditions. FOI 5290, listed under November 2025 in the disclosure log, expressly states that Barnsley operates neither selective nor additional licensing. The current Private Sector Housing Plan commits to periodically reviewing the need for those schemes; this is not itself a designation or formal consultation. Older consultation reports must not be treated as operative schemes. The HMO page still contains £30,000 penalty wording; the May 2026 civil penalties policy is the current policy source. A further response, FOI 6712 listed under August 2026, says there is no selective or additional scheme in answers about licences on 31 March 2025. Its question dates are historical; this is supporting evidence, not a standalone guarantee of October 2026 status.

Article 4 for house shares
Barnsley has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.
- Area
- Whole Barnsley Metropolitan Borough for changes from C3 dwellinghouses to C4 small HMOs. The confirmed direction includes the borough boundary plan, covering the wider borough rather than Barnsley town alone. The restriction operates from confirmation on or after 20 May 2021; the signed confirmation is dated 24 June 2021, also confirmed in the council's 2021–2022 monitoring report.
- Takes effect
- 24 Jun 2021
Civil penalty policy
The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.
The final policy explicitly records approval on 22 April 2026 and implementation and application from 1 May 2026. It includes Renters' Rights Act breaches, the £7,000 and £40,000 statutory maxima, offence-specific starting points and landlord type, aggravation, mitigation, financial benefit and totality adjustments. Failure to obtain an HMO licence starts at £17,000 before adjustments, with landlord type examples of £13,600 and £20,400. A further standard 25% reduction reflects Barnsley's lower average rents and is applied after other calculations; the council also considers deterrence and financial benefit. A 15% prompt payment discount normally requires payment within 28 days beginning the day after the final notice; an appeal does not extend the discount period. These are calculation factors, not a guaranteed penalty for a particular case. The May 2026 housing enforcement policy is linked from the current landlord responsibilities page: barnsley.gov.uk
Consultations
We found no consultations when we researched Barnsley.
Not yet confirmed
We could not settle these points when we researched Barnsley on 15 October 2026. Check them with the council before you rely on them.
- Not yet confirmed
Keep optional licensing status under review. The November 2025 disclosure log and FOI 5290 expressly report no selective or additional schemes; current council pages and targeted committee searches did not establish a later designation, recent expiry or live consultation. The housing plan promises periodic review, without a current scheme timetable.
- Not yet confirmed
Confirm the current fee year, any separately priced renewal category and the additional DBS charge. The live HMO page quotes £800 plus bedroom supplements without a financial year or separate renewal fee.
- Not yet confirmed
Confirm the actual licence conditions and any shorter licence term for the individual property. The council says licences usually last five years; amenity guidance is not the full issued licence.
- Not yet confirmed
The Article 4 instrument refers to confirmation on or after 20 May 2021, but its signed confirmation is 24 June 2021. The latter is used here, corroborated by the council monitoring report: https://www.barnsley.gov.uk/media/25183/authority-monitoring-report-2021-22.pdf. Seek the council's advice on any historical change of use between those dates.
Landlord register
The national landlord register is separate from licensing. Barnsley is in Yorkshire and The Humber, where registration is planned from 15 April 2027 to 14 July 2027. The regulations are still in draft. Read about the register
