Article 4 for house shares
Broxtowe has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.
- Area
- Parts of Beeston and Beeston Rylands only, as shown on the council's map (https://www.broxtowe.gov.uk/media/8306/site-notice-map.pdf). Within that area planning permission is needed to change a dwellinghouse to an HMO with 3-6 residents. Consulted 15 January to 26 February 2021; confirmed by the Jobs & Economy Committee on 25 March 2021; in force 26 March 2022.
- Takes effect
- 26 Mar 2022
Civil penalty policy
The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.
Broxtowe Borough Council Private Sector Housing Civil Penalties Policy (March 2026), Appendix 2 to the Cabinet report of 2 June 2026, which resolved that 'The updated Housing Civil Penalties Policy be approved' alongside a Private Sector Housing Enforcement Policy incorporating the Renters' Rights Act 2025 (democracy.broxtowe.gov.uk). Offences such as failure to obtain a selective licence (s.95) carry a statutory maximum of £40,000, with a civil penalties matrix. An earlier civil penalties policy went to the Housing Committee on 2 February 2021. The HMO licence page still cites £30,000.
