    Mandatory HMO licensing

    Area

Current Buckinghamshire Council administrative area. The current application guidance is unified; historical Aylesbury Vale, Wycombe, Chiltern and South Bucks application pages or schemes must not be generalised as current county-wide optional licensing. Milton Keynes is a separate council.

    Fee

    Not yet confirmed

Current application page publishes a £500 non-refundable application payment and a table headed New and renewal: proactive £1,050; through enforcement £1,575; proactive landlord-association member £998, for five bedrooms. It describes two stages (application payment and licence fee) but does not explicitly state whether the £500 is credited against the table amount or added to it. A total is therefore not inferred. The main page says +£50 per extra bedroom; the fetched schedule headed applicable from 1 April 2026 lists the same base table but +£53 per extra bedroom, a source conflict. Confirm the total and bedroom supplement before budgeting. Published ancillary charges: copy £44, advice visit £184, variation £184; enforcement officer time charged hourly. The 2026/27 document is a draft/proposed schedule in its URL, not by itself evidence of final budget adoption.

    Who needs one
HMOs occupied by five or more people in two or more households, with occupants using the accommodation as their only or main residence. The council says the mandatory regime includes flats, bungalows and two-storey properties. Confirm the statutory HMO definition and exemptions for the building.
    How we checked this

Licences usually up to five years; shorter terms possible for enforcement/non-compliance history. Online applications only; completed declarations are required from the proposed holder, manager and person having control, followed by inspection and proposed-licence consultation. No current selective/additional designation, approved proposal, active consultation or optional scheme ending since 15 October 2025 was identified in current unified guidance and targeted council/committee/consultation searches. This is a bounded research finding, not express current council assurance of absence. Historical primary committee minutes reproduced in the September 2019 pack record support for non-renewal of the former Aylesbury Vale additional scheme after September 2019; they also say other Bucks districts then had no additional scheme. Existing individual licences could continue to their own expiry. That historical scheme is outside the preceding 12 months and is not shown as current or recently expired. Historic enforcement figures on the 2020 standards page must not be reused as current law.

Council source

Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

The fetched policy is titled Civil penalties policy under the Renters’ Rights Act. Leader decision 24 April 2026 approved updated Housing Enforcement and Civil Penalty Policies for duties from 1 May 2026; portal effective date is 30 April 2026. Primary decision buckinghamshire.moderngov.co.uk was retrieved via Exa official-page extraction after native403. The policy covers the expanded Act framework and statutory £7,000/£40,000 tiers; use its case-specific matrix and adjustments rather than historic £30,000 statements on older HMO standards pages. No later replacement identified.

Not yet confirmed

We could not settle these points when we researched Buckinghamshire on 15 October 2026. Check them with the council before you rely on them.

  • Not yet confirmed

Clarify the current HMO total: is the £500 application payment a credit against the table (£1,050 proactive / £1,575 enforcement / £998 association member) or an additional charge? Source prose is ambiguous, so standard_gbp is null instead of assuming £1,050 or £1,550.

  • Not yet confirmed

Resolve the extra-bedroom charge conflict: current main page says £50; schedule headed applicable from 1 April 2026 says £53. Retrieve the adopted final 2026/27 schedule or council confirmation; no unsupported fee reconciliation.

  • Not yet confirmed

Obtain express current confirmation of no selective/additional scheme, approved designation or live consultation across the current unitary area, including former Aylesbury Vale, Wycombe, Chiltern and South Bucks. Targeted searches and current unified guidance found none, but this is not proof of absence.

  • Not yet confirmed

Obtain explicit HMO C3-to-C4 Article 4 status from planning and check the relevant current direction/order for the exact address. The generic register and targeted searches do not establish an authoritative negative, so exists remains null.

  • Not yet confirmed

Confirm statutory exemptions and any updated mandatory HMO conditions replacing historical 2020 standards text where it conflicts with later legislation. No exemption is invented from the generic page.

Landlord register

The national landlord register is separate from licensing. Buckinghamshire is in South East, where registration is planned from 15 March 2027 to 14 June 2027. The regulations are still in draft. Read about the register
