Licensing schemes

  • Mandatory HMO licence

    In force

Mandatory HMO licensing (national scheme, Eastleigh fees)

    Area

The whole of Eastleigh Borough (national scheme).

    Fee

    Published standard fee: £1,450

Council 'Housing fees and charges' page, 'From 1 October 2026': HMO licensing £1,450 (column headed 'Fee (inc VAT)'); pre-licence application site visit for advice or build requirements £330. The licence page says the charge is paid in two stages, the first in full with the application (non-refundable) and the second only when a decision is made to grant. The HMO information pack (2021 text, 2023 accessible version) says the second payment is increased for each unit of accommodation over five at a set rate and is adjusted pro rata for a shorter licence; neither the per-unit rate nor the split between the stages is published on the current fees page.

    Who needs one
Any HMO with five or more occupants forming two or more households who share a basic amenity such as a toilet, bathroom or kitchen (council HMO licence and HMO pages).
    How we checked this

The licence page says 'We currently only operate a Mandatory Licensing Scheme' (no additional or selective licensing). The HMO information pack (2023) says a licence 'cannot last longer than 5 years', with shorter terms at the council's discretion; licence_length_years records that maximum. A public HMO licence register (October 2026, XLSX) is published.

Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

Private Sector Housing Civil Penalties Policy dated 29 April 2026, reported with the updated Private Sector Housing Enforcement Policy (June 2026) to Policy and Performance Scrutiny Panel on 11 June 2026 and Cabinet on 18 June 2026 'in response to the duties imposed by the Renters' Rights Act 2025'. It applies the £7,000 and £40,000 statutory maxima. Starting points include mandatory HMO unlicensed (s.72(1)) £17,000, additional HMO unlicensed £17,000, selective licence unlicensed (s.95(1)) £12,000, knowingly permitting over-occupation of an HMO £20,000, failure to comply with an improvement notice £25,000, each capped at £40,000 and adjusted for aggravating and mitigating factors. Licence-condition breaches (s.72(3), s.95(2)) use the council's own starting levels. The council's housing policies page labels the June 2026 financial assistance policy as the 'Private Sector Housing Enforcement Policy'; the enforcement policy itself is at /media/16960/psh-enforcement-policy-june-2026.pdf.
