HMOs occupied by five or more people forming at least two households (council HMO page).
    How we checked this

The HMO page says 'Generally speaking a licence will be granted for a 5 year term unless there are reasons not to.' Applications need a fire risk assessment, fire detection test report, gas safety certificate, EICR from the last 5 years, PAT report, emergency lighting report if installed, an EPC and a floor plan meeting the council's floor plan standards. An abbreviated HMO register is published on data.gov.uk; the full register is available from foidpa@epsom-ewell.gov.uk.

Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

The Community and Wellbeing Committee on 5 March 2026 (minute 36) unanimously adopted a revised Housing Civil Sanctions Policy 'with effect from 1 May 2026' to take account of the Renters' Rights Act offences (democracy.epsom-ewell.gov.uk). Appendix 1 sets failure to obtain an HMO licence (s.72(1)) at a £17,000 starting point (landlord-type adjustment £13,600 / £20,400) within the £40,000 statutory maximum. It replaces the July 2025 policy (Housing and Planning Act 2016, up to £30,000). The same meeting (minute 37) adopted a separate housing enforcement policy.
