How we checked this
Council page: 'A licence will normally last for a maximum of five years, although it can be for a shorter period.' The page links an online form to apply for or renew a licence. Re-checked against the rendered live site on 26 October 2026 (the site had been in maintenance earlier that day).
Article 4 for house shares
Whether Fylde has an Article 4 direction on house shares.
Civil penalty policy
The council's policy sets how it decides the size of a fine. The version we found has not been updated for the Renters' Rights Act.
Civil Penalty Policy under the Housing and Planning Act 2016 (cover dated August 2025). It states a maximum of £30,000 per offence and predates the Renters' Rights Act 2025. Starting levels by seriousness: Mild £2,500, Moderate £7,500, Serious £12,500, Very Serious £17,500, Severe £22,500, Very Severe £27,500, then adjusted for portfolio size and aggravating or mitigating factors (normally by no more than £5,000 each way). Failure to license a mandatory HMO (s.72(1)) is treated as Very Serious: £12,500 for a landlord with one HMO and at most one other dwelling, £17,500 for three to five dwellings or two HMOs, £22,500 for six or more dwellings, three or more HMOs or demonstrated experience. The council's Renters' Rights Act page refers to civil penalties generally; the 24 March 2026 Executive Committee item on the Act concerns new-burdens funding only, not a revised policy.

Not yet confirmed
We could not settle these points when we researched Fylde. Check them with the council before you rely on them.
- Not yet confirmed
No selective or additional licensing scheme was found: the council site search for 'selective' returns nothing and for 'additional licensing' only the mandatory HMO page; the HMO page says only HMOs with five or more people in more than one household need a licence; the committee document search (fylde.cmis.uk.com) for 'selective licensing' and 'additional licensing' returns no documents. The council does not expressly state the absence.
- Not yet confirmed
Absence of an HMO Article 4 direction is inferred from the council's Article 4 list (three Lytham heritage directions) and planning.data.gov.uk (no Fylde records).
- Not yet confirmed
The civil penalty policy has not been revised for the Renters' Rights Act 2025 maxima (£7,000 / £40,000).
Landlord register
