Leeds City Council Designation for an Area for Selective Licensing – East, South and West Leeds (2025 designation)

    Area

The residential area edged in black on Annex A of the designation, covering only parts of Armley, Beeston and Holbeck, Burmantofts and Richmond Hill, Farnley and Wortley, Gipton and Harehills, and Hunslet and Riverside. Ward membership alone does not establish coverage. The accompanying indicative street list is not a definitive address list; some entries cover only specified sides or stretches, so use it with the designation map or council confirmation. The consultation map is not a substitute for the final designation.

    Runs
    9 February 2026 to 7 February 2031
    Fee

    Published standard fee: £1,100

Current online application total £1,100: from 26 February 2026 Part 1 £400 on application and Part 2 £700 on successful application. Paper application total £1,225 (£525 + £700). Eligible Leeds Rental Standard members who own the property receive a £150 reduction in Part 2 (£550 instead of £700). The main page and guidance agree on these current table amounts. Applications made before 26 February 2026 originally paid £675 + £425 online or £800 + £425 on paper; the council offers specified partial-refund/re-apportionment arrangements. The main page has an inconsistent £525 membership balance in that transition paragraph; do not substitute it for the £550 current fee table. Part 1 is generally non-refundable; exceptional duplicate/non-licensable applications are considered. No discount for multiple properties or smaller properties.

    Who needs one
Privately rented houses and individual self-contained flats in the designated area occupied under a tenancy or licence, unless exempt or required to be licensed under Part 2 HMO licensing. The guidance includes small shared HMOs that do not require a mandatory HMO licence and advises asking the council where a building contains separate units or shared amenities.
    Exemptions
The designation excludes properties required to be licensed under Part 2 of the Housing Act 2004, tenancies granted by registered social landlords, properties under interim or final management orders, temporary exemptions under section 86, and statutory exempt tenancies or buildings listed in Annex B. Council guidance gives examples including holiday lets, business premises, socially let properties, university-owned student accommodation, a resident landlord with up to two lodgers, and qualifying family-member lettings. A family-member letting is not automatically exempt: the statutory definition must be met.
    How we checked this

Designation made on 3 November 2025, following Executive Board consideration on 15 October 2025, using the 2024 General Approval without individual Secretary of State confirmation. Paragraph 3 of the final designation says it "shall cease to have effect on 8th February 2031"; end_date therefore records 7 February as the last day in force. This conflicts with the application guidance and compliance guide, which call 8 February 2031 the expiry/end date, and the press notice describes a five-year period. Council clarification is required. The designation writes ward names with "and"; the list above uses current ONS ampersand spellings. The map, not every property in the six wards, defines the area; street list entries include partial lengths/sides. Apply separately for each property or self-contained flat. The council says applications were due by 9 February 2026 and purchasers after that date should apply within 14 days of completing purchase. Selective licences run only to the end of the designation, so late applications do not buy five fresh years. The prior Beeston and Harehills schemes are described by the consultation page as ending on 5 January 2025, outside the last-12-month expired-scheme window. The superseded consultation page still contains historic wording suggesting no decision has been made; use the final November 2025 designation for current status.

  • Mandatory HMO licence

    In force

Mandatory HMO licensing (national scheme, Leeds fees)

    Area

The whole Leeds local authority area under the national mandatory HMO licensing regime.

    Fee

    Published standard fee: £975

Current council HMO licensing page lists the licence fee for all properties as first stage £635 plus second stage £340, total £975. Leeds Rental Standard members pay £635 + £190, total £825 (£150 discount on the second part). The page gives the same fee information for applications and renewals, with payment requested after the council receives the form. No fee effective date is shown.

    Who needs one
HMOs rented to five or more people from more than one family or household who share a toilet, bathroom or kitchen, as stated on the council HMO licensing page.
    How we checked this

Licences usually last five years. The council takes account of fit-and-proper status, management and financial means, refuses overseas proposed licence holders, and requires a new application on sale because licences do not transfer. A draft licence is issued before the final licence; the council page allows 16 days to question conditions. A completed application or renewal form is posted to the licensing team, and the council then supplies payment details. The current advisory notes are dated March 2022. The May 2026 enforcement policy says late or previously unlicensed operators may receive reduced-term licences. No additional HMO licensing designation or live additional-licensing consultation was located in the current licensing pages, May 2026 policy or targeted council/committee searches; a generic description of additional licensing powers in the policy is not evidence that a scheme exists.

Article 4 for house shares

Leeds has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.

Area
The land edged red on the council Article 4 area plan, covering parts of inner Leeds rather than the whole city. The council area page uses older ward labels including Headingley, Hyde Park and Woodhouse, City and Hunslet, and Beeston Hill and Holbeck; those labels must not be matched as if they were current ward boundaries. The direction removes permitted development for the C3 dwellinghouse to C4 small-HMO change of use. Check the mapped area separately from licensing.

Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

The current published policy expressly works with MHCLG civil-penalty guidance under the Renters’ Rights Act 2025 and includes the new Housing Act 1988 tenancy breaches, RRA discrimination breaches, and increased £40,000 maximum for relevant Housing Act offences. Appendix 2 gives a £17,000 starting point for unlicensed mandatory or additional HMOs and £12,000 for an unlicensed selectively licensable property; case-specific aggravation, mitigation, financial gain and totality then apply. The May 2026 enforcement policy links this current civil-penalty policy. The November 2025 selective press notice still quotes the earlier £30,000 maximum and is not the current penalty policy.

Consultations

Not yet confirmed

We could not settle these points when we researched Leeds on 15 October 2026. Check them with the council before you rely on them.

  • Not yet confirmed

Resolve the final designation paragraph 3 wording "cease to have effect on 8th February 2031" against guidance that says licences expire on 8 February 2031. The last-day convention currently gives end_date 2031-02-07; the source discrepancy is explicit rather than silently treating 8 February as inclusive.

  • Not yet confirmed

The final scheme covers only parts of the six named current wards. Without the final map or council address confirmation, neither a matching ward nor a name in the indicative street list proves that a particular number/side of a street is covered.

  • Not yet confirmed

The selective fee page transition/refund paragraph mentions a £525 balance for Rental Standard members, but its current fee table and application guidance both show Part 2 £550. Confirm transitional cases with the council; the current standard total is £1,100 online.

  • Not yet confirmed

No additional HMO licensing designation, approved future scheme or open consultation was found in targeted leeds.gov.uk/democracy.leeds.gov.uk searches, current HMO/selective pages and the May 2026 enforcement policy. This is a documented search result, not a guarantee that no future proposal will be made.

  • Not yet confirmed

The mandatory HMO fee page shows no effective date. The live £975 table is recorded as fetched on 15 October 2026; no later HMO fee schedule was identified.

  • Not yet confirmed

The current HMO page does not list all statutory licensing exemptions; confirm unusual building/ownership cases with the council. No exemptions have been guessed.

  • Not yet confirmed

The Article 4 order and mapped-area page were fetched; the order is scanned and was visually read to confirm commencement on 10 February 2012 and confirmation under seal on 25 August 2011. Its map uses a defined boundary rather than present-day ward-wide coverage.

  • Not yet confirmed

Independent verification on 15 October 2026 confirmed the active selective scheme, partial-six-ward applicability, start date and current fees from multiple live Leeds council pages. The democracy.leeds.gov.uk designation and decision URLs returned HTTP 403 during verification, so the exact legal cease wording and final last-day discrepancy could not be independently re-fetched. The legal-text end_date has been retained from research with the existing discrepancy explicit; it must not be presented as independently resolved.

Landlord register

The national landlord register is separate from licensing. Leeds is in Yorkshire and The Humber, where registration is planned from 15 April 2027 to 14 July 2027. The regulations are still in draft. Read about the register
