Privately rented houses or flats let or occupied under a tenancy or licence within the exact Part 1 area, unless exempt.
    Exemptions
Designation exempts properties requiring Part 2 HMO licensing (mandatory or additional), registered-social-landlord tenancies, interim/final management orders, section 86 temporary exemptions, and other statutory/Annex exemptions. Selective licensing does not duplicate the appropriate HMO licence.
    How we checked this

Made 22 October 2024 after Executive approval 14 October 2024; comes into force 5 April 2025. Paragraph 3 says “shall cease to have effect on 5 April 2030”: last day 2030-04-04 under this dataset’s convention. Exact street/number/odd-even restrictions in designation control; these are not whole electoral wards. Matcher streets remain empty to require an exact-address map/designation check. New 2025 conditions apply to this scheme; current conditions page also requires five hours housing training per year. Individual licences normally up to five years, with shorter terms for non-compliance per council FAQ.

Made and Executive-approved 24 February 2026. Both designation paragraphs 2–3 and public notice specify commencement 30 September 2026 and remain in effect “up to and including 29 September 2031”; these dates are recorded. Current selective landing page and 12 May 2026 news release instead say 1 October 2026; council confirmation needed. Designation footer erroneously says Date 24 February 2024, while operative body/approval/public notice say 2026. Newly designated boundaries must be checked, not assumed identical to 2021. The conditions landing page still says April 2025 conditions exclude Byker/High Cross and links 2023 conditions for those areas; no specific 2026 conditions document was established, so conditions_url points to that official selection page pending confirmation. Independent visual inspection of the designation table resolves the extraction ambiguity: Manisty House is in the Atherton Drive row, consistent with the public notice. Exact-property checks still follow the instrument; no inferred whole-street matcher coverage.

Brook Street source error: designation prints “70-74 evens, 71-76 odds”; public notice prints “70-74 odds and 71-76 odds”. The odd endpoint 76 is intrinsically inconsistent. Scarborough Court lacks an explicit All/Part entry in designation and public notice spells Scarbrough Court. No corrections, whole-street assumptions or number-range matcher are invented; council/address-plan confirmation required.

    Runs
    5 April 2025 to 4 April 2030
    Fee

    Published standard fee: £1,100

2026/27 council schedule effective 1 May 2026: first HMO licence £1,100 (£400 application/processing + £700 enforcement), plus £20 for each occupant above five. HMO renewal £1,000 (£300 + £700); current application guidance says mandatory renewal must be made before expiry or it is a new application. Discounts: £100 EPC C or above; £50 valid new application within one month of purchase; £100 accreditation (licensing page/June 2025 schedule explicitly restrict accreditation to mandatory HMO). Current licensing page still links June 2025 £1,100 split £350/£750 without occupant multiplier; later effective 2026/27 schedule is used for current base/split/multiplier. No unsupported stacking or additional-renewal discount is inferred.

    Who needs one
Designation paragraph 5A: three or more persons, two or more households, meeting section 254(2) standard test, section 254(3) self-contained flat test subject to its purpose-built exclusion, or section 254(4) converted-building test; OR paragraph 5B buildings meeting section 257 criteria. The scheme is therefore broader than just three/four-person shared houses.
    Exemptions
Paragraph 5A(ii) excludes purpose-built flats situated in a block comprising three or more self-contained flats. Paragraph 6 excludes interim/final management orders and section 62 temporary exemptions. A property subject to mandatory licensing needs the appropriate mandatory licence rather than a duplicate additional licence; check statutory exemptions.
    How we checked this

Made 22 October 2024 following Executive approval 14 October 2024. Paragraph 2 commencement 5 April 2025; paragraph 3 “shall cease to have effect on 5 April 2030”, so last day 2030-04-04. Replaces the April 2020 citywide scheme, which ended before the past-12-month window. Current landing page summarises smaller HMOs but operative designation expressly includes section 257 and excludes the specified purpose-built flat category; operative scope is preserved. No blanket statement that all flats or all three-person properties qualify. Individual licence duration may be shorter than scheme duration.

    Who needs one
HMOs with five or more occupants in two or more households sharing kitchen/bathroom facilities, subject to the national prescribed description and statutory exemptions.
    How we checked this

Council mandatory guidance confirms national threshold. Licence normally up to five years; current FAQ says compliant applicants receive five years and non-compliance can lead to one year. Applications made online with two fee payments; renew mandatory before current expiry. Licensing and Article 4 planning restrictions are separate.

Greater High Cross and Byker selective licensing 2021 (expired)

    Area

Original 2021 designation uses three separate geographic parts: Greater High Cross area bounded by Adelaide Terrace (north), St Johns Road (east), Atkinson Road (west), Armstrong Road (south), plus area bounded by Armstrong Road (north), Atkinson Road (east), South Benwell Road (west), Whitehouse Road (south); Byker Old Town bounded by Welbeck Road (south), Roman Avenue (east), Grace Street (north), Bothal Street (west); Byker Allendale South: 63–189 Allendale Road, 1–7 Bird Nest Road, Chatsworth Gardens, Irthing Avenue, Relton Avenue. Boundary roads are not automatically treated as both sides/whole streets. Use original designation/plan for exact address; 2026 replacement is separately delineated.

    Fee

    Not yet confirmed

Historical 30 June 2021 letter states £650 five-year fee (£175 application + £475 issue). That launch fee is not asserted as the fee payable immediately before September 2026 expiry; current 2026 schedule separately states £1,000 selective fee.

    Who needs one
Private rented houses in the original three designated 2021 parts, subject to statutory exemptions; retained as an expired designation, not current licensing coverage.
    Exemptions
Statutory selective exemptions apply; the retrieved short 2021 public notice does not reproduce a detailed exemption schedule.
    How we checked this

Cabinet 21 June 2021; public notice 29 June 2021 and covering letter 30 June 2021. Commencement 1 October 2021; notice says “shall cease to have effect on 30 September 2026”, giving last day 29 September 2026 under dataset convention. Included because ended in last 12 months. This is distinct from the new 30 September 2026 designation, whose street numbering/boundaries differ. Do not apply current scheme’s boundaries, conditions or assumed fee retrospectively.

Article 4 for house shares

Newcastle upon Tyne has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.

Area
Three separate mapped C3-to-C4 directions, not citywide: parts of Heaton, High West Jesmond, Jesmond, South Gosforth, Sandyford and Spital Tongues effective 25 November 2011; parts of High West Jesmond/North Jesmond effective 9 December 2012; Saint Gabriel’s Estate, Heaton effective 9 August 2013. Exact plans linked from council planning guidance control; locality names are not whole wards. One effective_date cannot represent all three, so null is intentional.

Council source

Civil penalty policy

The council's policy sets how it decides the size of a fine.

Current council private-sector-housing enforcement page still links June 2023 Civil Penalties Guidance and Housing Enforcement Policy 2023: newcastle.gov.uk . Retrieved guidance is pre-RRA: culpability/harm band + income/track record + financial benefit, and states £30,000 maximum. It is not treated as current post-RRA statutory ceiling. Searches retrieved an April 2026 Trading Standards Tenant Fees Act policy explicitly updated for RRA, but it is a distinct tenant-fees enforcement policy, not proof that this housing-licensing matrix has been updated. No housing-policy replacement/adoption decision was established; RRA update status remains null pending council confirmation. Newcastle-under-Lyme March 2026 policy decisions are a different authority and excluded.

Resolve current guidance/news 1 October 2026 commencement against both legal designation and public notice 30 September 2026. Legal dates are retained, not silently aligned to web copy. The 2021 notice’s cease-30-September wording gives prior last day 29 September under schema.

Confirm new 2026 Brook Street ranges/odd-even sides and Scarborough/Scarbrough Court inclusion. Full designation/public notice disagree and contain apparent printing errors; no inference is encoded. The Manisty House alignment has been independently resolved from PDF pixels as Atherton Drive, consistent with the public notice. Obtain council confirmation for unresolved addresses.

All selective areas use kind=other and empty wards/streets because boundaries contain specific addresses and partial streets; whole current wards cannot safely substitute. The 2025 designation labels five areas but enumerates Parts 1–6; all six are retained. No independent polygon extraction has been undertaken.

  • Not yet confirmed

Confirm the final 2026 licence conditions for Byker/High Cross: current conditions guidance excludes those areas from April 2025 conditions and links older 2023 conditions. Do not apply the 2025 suite indiscriminately.

  • Not yet confirmed

Confirm whether a post-RRA private-sector-housing civil penalty policy has replaced the current page’s 2023 policy/guidance. The April 2026 Tenant Fees Act policy does not resolve the licensing matrix; Newcastle-under-Lyme policies are excluded.

  • Not yet confirmed

Confirm the current 2026/27 HMO occupant multiplier, fee-stage split and applicability/stacking of accreditation discount in the licensing portal: later effective council schedule adds £20 per occupant above five and £400/£700 split; specialist fee landing page still links June 2025 £350/£750. Total base £1,100 agrees.

  • Not yet confirmed

No other new/proposed licensing consultation or operative designation was identified in current licensing pages, consultation results and targeted 2026 council searches as of 15 October 2026. Current recent-consultations page retains stale 2024 pending-result wording; signed 2024/2026 designations take precedence.

Landlord register

The national landlord register is separate from licensing. Newcastle upon Tyne is in North East, where registration is planned from 15 June 2027 to 14 September 2027. The regulations are still in draft. Read about the register
