Licensing schemes

  • Mandatory HMO licence

    In force

Mandatory HMO licensing (national scheme, North Warwickshire fees)

    Area

The whole of North Warwickshire borough (national scheme).

    Fee

    £904 for 5 years

    The council's HMO licensing page: new application £904 (5 to 9 occupiers), £952 (10 to 14), £1,000 (15 to 19), £1,046 (20+); renewal £833 (5 to 9), £870 (10 to 14), £907 (15 to 19), £944 (20+). The council's 'Fees and charges from 1 April 2026' schedule agrees except for the 5 to 9 new-application fee, which it shows as £804, and it also lists a '2-4' band (£856 new, £797 renewal) and a £187 licence variation fee. Licences are not transferable.

    Who needs one
A house in multiple occupation where five or more unrelated people live and all or some of them share a toilet, bathroom or kitchen.
    Notes
This is the national scheme. North Warwickshire publishes its own page and fees. Licences are usually granted for five years, but may be shorter if the property lacks planning permission or has known management failings. Applications are usually processed within 6 to 8 weeks and the council aims to visit every HMO before issuing a licence. New licence conditions apply to HMO licence applications received from May 2026. The page notes that since 2 March 2026 all new HMOs, regardless of size, need planning permission (see Article 4). The council says the direction is not retrospective, so existing occupied HMOs do not need permission.

Article 4 for house shares

North Warwickshire has an Article 4 direction on houses in multiple occupation. Turning a family home into a shared house may need planning permission.

Civil penalty policy

The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.

'Civil penalties under the Renters' Rights Act 2025 and other housing legislation' (Justice for Tenants model; the PDF was created on 22 June 2026). Statutory maximum £40,000 for licensing offences. Failure to obtain an HMO licence (s.72(1)) starts at £17,000, adjusted 20% for 'Landlord Type' (£13,600 downward, £20,400 upward). The offence list covers HMO licensing but not selective licensing. A 15% prompt payment discount applies. Older documents remain on the council site: a 'Civil Penalties Enforcement Policy & Guidance' (file 1480), a 'Financial Penalty Enforcement Policy & Guidance' (file 1478) and an Environmental Health and Private Sector Housing Enforcement Policy dated September 2024.

Consultations

No consultation was recorded when we researched North Warwickshire.

Not yet confirmed

These points were unresolved when we researched North Warwickshire on 14 October 2026. Check them with the council before you rely on them.

  • Not yet confirmed

The new-application fee for 5 to 9 occupiers differs between the HMO page (£904) and the 2026-27 fees schedule (£804). The page figure is recorded. Confirm with the council.

  • Not yet confirmed

The fees schedule lists a '2-4' occupancy band and a £187 variation fee, which the HMO page does not mention, while the council's GOV.UK licence page says 'We do not charge existing licence holders to vary a licence'. Confirm what applies.

  • Not yet confirmed

No selective or additional licensing scheme, consultation or proposal was found. The council does not state the absence, so this is inferred from its HMO pages covering mandatory licensing only.

  • Not yet confirmed

The adoption date of the Renters' Rights Act civil penalty policy was not found; only the document's creation date (22 June 2026) is known.

  • Not yet confirmed

Not independently re-checked (verification of 2026-10-14): the absence of a selective or additional scheme (council pages, site search and the October 2025 HMO Article 4 report only; no web search was possible); which of the £904 and £804 fees the council charges (the discrepancy was re-confirmed but cannot be settled from published sources); and when the civil penalty policy was adopted (no adoption date or committee decision was found).

Landlord register

Licensing is separate from the national landlord register. North Warwickshire is in West Midlands, where the planned registration window runs from 15 December 2026 to 14 March 2027. The regulations are still in draft. Register dates, fee and documents
