Licensing schemes
Mandatory HMO licence
In forceMedium confidenceMandatory HMO licensing (national scheme, Reigate and Banstead)
- Area
The whole Borough of Reigate and Banstead (national scheme).
- Fee
Not yet confirmed
The council's licensing page says there 'is a fee to be paid in respect of the licence application' but publishes no amount and links no fee schedule. A copy of the public register or an extract costs £65.
- Who needs one
- HMOs that 'accommodate five or more persons in two or more households', regardless of the number of storeys (council 'Licensing of HMOs' page).
How we checked this
Apply or renew online, uploading a fit and proper person declaration (reigate-banstead.gov.uk), floor plans, an EICR dated within 5 years, a gas safety certificate where there is gas, and BS5839 fire detection and BS5266 emergency lighting test reports where applicable. Licences carry the prescribed Schedule 4 conditions plus discretionary conditions (conditions_url is the statutory schedule, not a council schedule). The register of licensed HMOs may be viewed by appointment at the Town Hall. The council's HMO pages do not mention additional or selective licensing and show no page date. Confidence is medium because no fee or licence length is published.
Article 4 for house shares
Reigate and Banstead has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.
- Area
- Borough-wide, but not yet in force. The council made a non-immediate Article 4 direction on 30 July 2026 removing the Part 3 Class L(b) right to change a dwellinghouse (C3) to a small HMO (C4) across the whole borough; public consultation ran from 30 July to 24 September 2026. The 28 October 2026 Planning Committee report recommends confirming it and says 'When the direction is confirmed, the removal of the relevant permitted development rights will take effect from 30 July 2027.' Confirmation is delegated to the Head of Planning and Regulatory Services; confirmation notices are planned for 29 October to 5 November 2026. Until 30 July 2027 a C3 to C4 change of use remains permitted development; existing HMOs are not affected.

Obtain the current HMO licence fee and licence length; neither is published on the council's HMO licensing pages.
- Not yet confirmed
No selective or additional licensing scheme, proposal or consultation was found on the council's housing pages; the council does not state the absence. Committee-document searches (reigate-banstead.moderngov.co.uk) for "selective licensing" returned nothing and "additional licensing" only a 2005 item; the October 2026 Council member question on HMOs concerns the Article 4 consultation.
- Not yet confirmed
Obtain the council's civil penalty policy and confirm whether it has been updated for the Renters' Rights Act 2025.

Confirm that the borough-wide C3 to C4 Article 4 direction (made 30 July 2026) was confirmed after the 28 October 2026 Planning Committee, and that it takes effect on 30 July 2027. Council page: https://www.reigate-banstead.gov.uk/article4directionHMOs (it still described the direction as proposed when fetched on 26 October 2026).

Surrey local government reorganisation: the council's notice says 'from April 2027 East Surrey Council will replace the current areas covered by Elmbridge, Epsom and Ewell, Mole Valley, Reigate and Banstead, and Tandridge councils' (data processed from 1 April 2027 by East Surrey Council; https://www.molevalley.gov.uk/privacy-notice-local-government-reorganisation/). HMO licensing will then be run by the new council; check its fees and any new schemes after that date.
