Licensing schemes

  • Mandatory HMO licence

    In forceMedium confidence

Mandatory HMO licensing (national scheme, South Staffordshire fee)

    Area

    The whole district (national scheme).

    Fee

    £704

'The current fee for a licence is £704.00', covering the application process, inspection and licensing the property. No split, discounts or per-room charges are listed, and no date is given.

    Who needs one
HMOs occupied by 5 or more people forming 2 or more households who share facilities such as a kitchen, bathroom or toilet. HMOs with 3 or 4 tenants do not need a licence but must follow the HMO management regulations and fire safety rules.
    Exemptions
The council lists local authority-owned properties among exempt types; statutory exemptions under Schedule 14, Housing Act 2004 apply.
    Notes
No selective or additional licensing scheme was found; the council's HMO page describes only the national mandatory scheme. The page still describes licensable HMOs as having 'two or more storeys', a test removed nationally in October 2018; the national rule (5 or more people in 2 or more households, any number of storeys) applies. Applications use a PDF form (HMO_application 2025) sent to the Environmental Protection Team (environmentalprotection@sstaffs.gov.uk). A public HMO register is published (file dated May 2026). The page also still says the civil penalty maximum is £30,000, while the council's Renters' Rights Act page says councils can issue fines of up to £40,000 from 1 May 2026.

Not independently re-checked (verification of 2026-10-14): whether Cabinet has adopted a Renters' Rights Act civil penalty policy, because no committee portal could be reached; scheme absence rests on the council's own pages and site search, and no web search was possible.
