Mandatory HMO licence
In forceMandatory HMO licensing
- Area
Whole Wakefield Council district, including Wakefield, Castleford and Pontefract. Six mapped HMO Article 4 planning areas are separate from mandatory housing licensing.
- Fee
Published standard fee: £847
Live undated page fetched 15 October 2026: five bedrooms £847, or £677 for Responsible Landlords Scheme members; six to ten bedrooms £1,031, or £824 for members; above ten £1,031 plus £40 per extra bed space, or £824 plus £32 for members. No fewer-bedroom tariff inferred. Council EIR 1155 dated 12 October 2026 says fees will increase later in 2026 but gives no amount or start date. Current published values retained. Renewal tariff, payment-stage split, fee-year and early-bird offer not established.
- Who needs one
- HMOs occupied by five or more people forming two or more households sharing basic facilities such as kitchen or bathroom, regardless of storeys; subject to statutory exclusions.
How we checked this
Current opening guidance confirms mandatory five-person threshold without a storey test; a later paragraph retains the old storey threshold and £30,000 sanction, which are not treated as current law. Current application DOC and adopted 2018 standards fetched. They require supporting documents, fees and management/property information; actual issued conditions govern. Local licence duration remains unconfirmed. Responsible Landlords Scheme is voluntary accreditation. Actual EIR 1155 response dated 12 October 2026 expressly confirms no additional or selective licensing of single lets or HMOs. FOI 1177 dated 13 October answers only no selective areas, despite asking about both categories; not overread. Scrutiny item 49 on 14 January 2026 retains selective licensing under policy review following the 2021 finding that it was unsuitable; this is not a designation or defined consultation. Broadened current council/committee searches found no approved future designation, live defined licensing consultation or scheme expiry since 15 October 2025.

Article 4 for house shares
Wakefield has an Article 4 direction on HMOs (houses in multiple occupation, or shared houses). Turning a family home into a shared house may need planning permission.
- Area
- Six exact purple-boundary areas only: Castleford Centre North, Castleford Smawthorne, Wakefield Agbrigg, Wakefield College Grove, Wakefield Lincoln Street and Wakefield Peterson Road. These neighbourhood polygons are not whole current wards or the whole district. Direction made 23 October 2024, Cabinet confirmation decision 15 April 2025, sealed confirmation 9 May 2025; confirmation notice dated 5 June 2025 confirms commencement 24 October 2025. Sealed pages 1–2 and Agbrigg annex map visually inspected. C3-to-C4 conversions for three to six occupiers require permission in the areas; established use before commencement distinguished. Order/maps: https://www.wakefield.gov.uk/media/dgcfrio5/article-4-direction.pdf ; notice: https://www.wakefield.gov.uk/media/kzodhu14/article-4-direction-confirmation-notice.docx . Other Heath, St Johns and Whitwood Terrace conservation directions are not HMO directions.

Civil penalty policy
The council's policy sets how it decides the size of a fine. The version we found has been updated for the Renters' Rights Act.
Strategic Housing civil penalties under the RRA 2025 and other housing legislation, Appendix 3/version 1. Actual Cabinet minutes, 21 July 2026 item 20, approve Appendices 1–4: mg.wakefield.gov.uk . May in the filename is not the adoption date. Native ModernGov fetch returned 403; complete primary policy/minutes retrieved through Exa. Policy has £7,000/£40,000 tiers and HMO unlicensed starting point £17,000, adjusted to £13,600/£20,400 by landlord type. Selective entry is a generic power, not evidence of a scheme. Policy gives 33% prompt-payment reduction; example arithmetic is inconsistent, so no example net penalty asserted. Future amendments delegated; no later replacement recovered.
