Civil penalty up to £40,000
Topic
Safety

Who it applies to

Specified tenancies where the inspection report shows the electrical safety standards are or may not be met and requires further investigative or remedial work (C1 danger present, C2 potentially dangerous, or FI further investigation required). C3 (improvement recommended) does not require work.

What you must do

Ensure the further investigative or remedial work is carried out by a qualified person within 28 days, or within any shorter period specified in the report, starting with the date of the inspection and testing. If investigative work shows more work is needed, repeat the process for that work.

Deadline

Within 28 days of the certificate being issued

28 days (or the shorter period in the report) starting with the date of the inspection and testing.

Evidence to keep

  • EICR showing the codes
  • Invoices and completion certificates for the remedial work

If you do not comply

Civil penalty
Up to £40,000
Other consequences
The council must serve a remedial notice (28 days to comply) and may arrange the work itself and recover costs; where the report identifies urgent remedial action that has not been done in time, the council may, with the tenant's consent, arrange it and recover costs. Financial penalty under reg 11.

Notes

The regulation refers to further investigative or remedial work required by the report; the C1/C2/FI mapping comes from the GOV.UK guidance, which says C1 or C2 make the installation unsatisfactory and require remedial work, and FI must also be carried out.
