Furniture supplied in a furnished let must meet fire safety rules

Upholstered furniture, beds, mattresses, pillows and cushions you provide in a let must meet the Furniture and Furnishings (Fire) (Safety) Regulations, which is normally shown by a permanent label.

Who it applies to

Furnished or part-furnished accommodation let in the course of business where the landlord supplies furniture intended for private use in a dwelling (including beds and bases, sofa-beds, mattresses, pillows, cushions and upholstered furniture). Furniture made before 1 January 1950 is excluded. Bedding and floor coverings are not 'furniture' for these regulations.

What you must do

Do not supply furniture or other articles that fail the regulations' requirements. Furniture supplied with a let, including second-hand furniture, must meet the ignitability requirements for upholstery, filling materials and permanent covers (regs 5, 6 and 8(1)-(2)). New furniture within Schedule 7 must carry the permanent label it specifies; the label is the usual practical evidence of compliance, so replace items whose compliance cannot be confirmed (for example with the manufacturer).

Deadline

0 days before the start of the tenancy

Each new letting is a new supply; furniture must comply when supplied and when replaced.

Evidence to keep

  • Inventory recording that each upholstered item carries a compliant permanent label
  • Purchase receipts for replacement furniture

If you do not comply

Criminal offence
Yes, you can be prosecuted
Other consequences
Offence under the Consumer Protection Act 1987 s.12, enforced by trading standards: on summary conviction up to 6 months' imprisonment and/or a fine. Since 30 October 2025 proceedings can be brought within 12 months (previously 6). For licensed HMOs and houses, the licence holder must also keep furniture they provide safe and give the council a safety declaration on demand.

Notes

Since 30 October 2025 (SI 2025/531) the display label requirement was removed and certain baby and young children's products were taken out of scope; the permanent label requirement remains. No current GOV.UK landlord page covers this; the 'How to let' guide that did was withdrawn on 14 July 2026. The cited trading standards guide predates the 2025 amendment, so it is used only for the point that the regulations apply to landlords and agents who let furnished accommodation in the course of business.
